Binding terms

https://www.employmeet.com/ is made available by EmployMeet ABN 45 304 764 692 of PO Box 2155, Redcliffe North QLD 4020.

When you read the words ‘we’, ‘us’, or ‘ours’, it means EmployMeet. The words ‘you’, ‘user’ or ‘your’ means you, the visitor of our website.

By using our website, you are agreeing to be automatically bound by these terms and conditions, including our privacy policy (below). We encourage you to read and understand these terms and conditions before using our website.

We may update our terms and conditions from time to time and the new provisions will apply from the date they are updated.

What is EmployMeet?

  • EmployMeet is a website that helps connect employers with jobseekers, but not in the traditional way.
  • We put you face to face with each other at the first stage of the process by asking jobseekers to create video profiles introducing themselves.
  • Employers who are paid members can reach out to jobseekers to ask for resumes and organise interviews.

For jobseekers:

  • You must be at least 13 years old before setting up an account with us.
  • You agree to provide true and correct details when setting up your account and creating your profile and that you will keep those details up to date.
  • Before starting work, you should check with your employer what your role is and your employment arrangements. You should ask about the difference between your take home pay and what you are being paid, so that you understand what tax, student loan repayments and superannuation will be paid for you.

For employers:

  • You must comply with applicable child employment laws.
  • If you are arranging an interview with a jobseeker under the age of 18, you should invite them to have their parent or legal guardian attend with them.
  • You must always act respectfully and professionally when interacting with jobseekers. This includes taking into consideration a jobseeker’s specific circumstances (ie. age, location, availability) when arranging interviews or making other work arrangements.
  • You must meet the minimum standards of employment including paying appropriate wages, providing employee entitlements, contributing to superannuation, withholding tax and complying with any other legal obligations.

Payment and refunds

  • Both employers and jobseekers can create profiles and browse our website for free.
  • Fees only apply to employers who wish to make job listings and reach out to jobseekers.
  • Anyone who signs up as an employer receives a free 90-day trial. No credit card details are required to start the trial. Our free trial offer is only valid until 30 May 2021.
  • Once the free trial period expires, a fee will apply to employers if they wish to continue using our website to make job listings and reach out to jobseekers.
  • We have different pricing options. Please see our payment schedule: https://www.employmeet.com/for-employers.
  • EmployMeet uses Stripe to process payments. We do not need to collect or store your payment details.
  • Unfortunately, EmployMeet is unable to issue refunds if you change your mind and decide not to use the paid functions of our website. If we are obliged under Australian Consumer Law to provide a refund, we will do so.

All care, no responsibility

  • We are only here to help you connect, but we do not have any direct relationship with users. We do not carry out any independent checks on users including identity checks.
  • We do not take any responsibility for the validity and accuracy of any information shared or received through our website. It is the employer’s responsibility to check the validity and accuracy of any certificate, licences or other proof of qualifications provided by jobseekers.
  • We make no recommendations or comments on the quality and reliability of any user.
  • All interview arrangements and work arrangements are made between employers and jobseekers directly, at their own risk and responsibility.
  • We have no control over how jobseekers will be paid and what entitlements they will receive.

Complaints

  • If we receive a complaint about behaviour related to the use of our website, we will ask the person complained about to provide their version of events and reserve the right to remove them from our platform. We do not guarantee that we will remove a person from our website if we receive a complaint.
  • We are not responsible for attempting to resolve complaints between people using our website. If you have an employment related complaint you should contact the Fair Work Ombudsman. http://www.fairwork.gov.au/
  • We reserve the right to remove a person from our website for any reason and without explanation.

You agree:

  • to keep your contact details up to date
  • not to create more than one account with EmployMeet
  • not to share your username and password with anyone
  • to use our website at your own risk
  • to create backup copies of any content you post or store on our website at your own cost and expense
  • that we will not be liable to you or any other person for any damages whatsoever arising as a result of your use of our website in any way, subject to Australian Consumer Law
  • to indemnify and defend us from any claims, damages, liabilities, costs, or expenses related to your unauthorised use of our website or your breach of these terms and conditions

You acknowledge that:

  • we make no representation about your ability to secure an employee, secure work or earn an income as a result of using our website
  • we make no representation about the suitability, reliability, availability, timeliness and accuracy of anything contained on our website for any purpose, to the maximum extent permitted by applicable law
  • where warranties are implied by law, our total aggregate liability is limited at our discretion to the provision of our services again, or to a refund equal to the total amount paid by you, even if the amount is zero

You must not:

  • engage in any unlawful or immoral acts, or acts which are in violation of these terms and conditions
  • engage in threatening, harassing or defamatory behaviour
  • hack into areas of our website that are not intentionally made available to you
  • use our website in any manner which could damage, disable, overburden, or impair our website or interfere with any party’s use and enjoyment of our website
  • use the website as a lead generation tool for the benefit of your own business, or to manufacture “lists” in order to help your own business, without our written approval
  • engage in any internal or external spamming, or other similar actions
  • decompile, reverse engineer, or try to copy or imitate our online services or underlying content

Intellectual Property

EmployMeet owns the intellectual property rights in all content of our website or has permission to use or display the material on our website.

You can use our website content for your own personal use only (that includes the purpose of employing people in your business) and for no other purpose.

Any content posted on our website by other people is probably their intellectual property. You must ask permission from them before using any of their content outside this website.

If you believe there is material on our website that infringes third party intellectual property rights, please contact us.

Security

We make efforts to maintain the security of our website. However, we do not guarantee the security of our website, records or your data.

You are encouraged to install and maintain up-to-date security software on your devices. If you get any computer virus or technological problems, we will not be responsible.

As a result, our website may be inaccessible from time to time due to third party providers. Although how the internet can still drop out in this day and age is beyond us!

General

This agreement is governed by the laws of Queensland, Australia. If you want to have an argument with us, you have to do it in Queensland.

The relationship you have with us is user of the services we make available through the website, and that’s it.

If any of these terms and conditions are determined to be invalid or unenforceable, then the invalid or unenforceable provision will be severed, and the remainder of the terms and conditions will continue in effect.

Staying Anonymous

You can browse our website anonymously. However, if you would like to set up an account with us, you will need to identify yourself and then we will collect your personal information.

Collecting personal information

At all times we try to only collect the information we need for the service we are providing. This may include your name, phone number, email, work information, location, occupation, device and connection information and your EmployMeet username and password.

The main way we collect personal information about you is when you give it to us, for example:

  • when you contact us
  • when you create an account with EmployMeet
  • when you upload or post information on our website
  • when you ask to access information we hold about you
  • when you link with us on social media

You agree that, for compliance purposes, we may keep any of your personal information for a period of seven years, although we are not obliged to do so.

Social Networking Services and links to other websites

We may provide links to other websites or use social networking services such as Facebook. These sites have their own privacy policies.

When you communicate with us using these services, we may collect your personal information. We will only use it to help us communicate with you. A social networking service will also handle your personal information for its own purposes.

Collecting sensitive information

We do not actively collect sensitive information about you, including information about your health, racial or ethnic origin, political opinions, religious beliefs, sexual orientation or criminal history. We will take steps to appropriately protect any sensitive information we do receive. A new employer may ask you to provide some sensitive personal information for their own purposes.

Disclosure

The information we collect about you is used only to providing you with our services.

We provide access to your personal information in accordance with Australian privacy law.

We may share your personal information with our professional advisors to obtain advice, or for compliance with our accounting or legal obligations.

Security and overseas recipients

We use industry accepted safe practices and appropriate password protection for our systems and aim to ensure our third-party providers use similar care with your personal data. No security measures are 100% safe however and your data is stored with us at your own risk.

We take reasonable steps to protect all personal information within our direct control from misuse, interference, loss, unauthorised access, unlawful or accidental destruction, modification or disclosure. To prevent unauthorised access or disclosure we use respected hosting services, firewall and other electronic security.

We rely on reputable third-party providers to store the information you have provided to us securely. Your data may cross international borders. Where possible, we nominate Australia as the storage country however, for many of our third-party providers, this is not possible, and your information will be sent or mirrored internationally. You agree to us transferring your personal data across international borders in this way.

We use a range of tools provided by third parties including search engine browsers and our web hosting company, to collect or view social media or website traffic information. These sites have their own privacy policies. We may also use pixels, cookies and session tools to improve your experience when accessing our website.
